Can my mortgage company take my tax refund if i am in foreclosure?

Question by darwinsti: Can my mortgage company take my tax refund if i am in foreclosure?
We are in “accellerated” foreclosure. We haven’t received the notice of sale, but the company refuses to accept any payment from us unless it is the full arrears. Yet, they took our federal tax refund and i was told that legally since we are in foreclosure, they have to return the refund. Is that right?

I am buying a house that is a short sale and we close in 45 days. Can I rent the house till the closing date?

Question by DD: I am buying a house that is a short sale and we close in 45 days. Can I rent the house till the closing date?
I close on my current house in a week and I would like to move into the “short sale” house right away and rent it. I don’t want to put my stuff in storage or rent another place. But our buyer’s agent tells us that the bank does not want us to rent. There is something about “you cannot rent a short sale house.” I want to find out if that is true or not. Any help is greatly appreciated.

a short sale, seller carry back sale
institutional financing sale are all
sales, contract based deals.

ALL contracts can be negotiated.

Thus, ask the seller!

Does anyone know where I can find legal assistance in Wisconsin?

Question by Mary J: Does anyone know where I can find legal assistance in Wisconsin?
I need an attorney or an organization knowledgable in ADA and civil rights law that is willing to take on a class action suit for discrimination and civil rights violations. The attorneys I have spoken to either are not knowledgable in both areas or claim it will be a conflict of interest. I have found one, but I can not afford the retainer. Also, Wisconsin Judicare can’t help me.

Check with your local chapter of United Way and see if they have a telephone number to Legal Aid in your area.

Q&A: Can the new owner of a foreclosed property collect back rent?

Question by : Can the new owner of a foreclosed property collect back rent?
I recently found that the owner of the property I live on was in foreclosure. For this reason I’ve held on to 2 months of rent. We were informed that the property had been purchased and the new owner wanted to collect the back rent. Can they do that even if they did not own the property at that time?

Best answer:

Answer by bdancer222
Actually, it was not legal for you to withhold the rent in the first place.

The new owner may or may not be entitled to the back rent. It all depends on the terms of the purchase agreement. Maybe you should contact the former owner and ask it the back rent was passed to the new owner.

In any case YOU owe some one for that back rent.

How can a voluntary repossession hurt you?

Question by lisanicole_98: How can a voluntary repossession hurt you?
My husband and I live in a crap, crap, crap, did I mention crap mobile home. Well, now we need to buy a house becuase our place is falling apart and I hate that my son has to grow up in such a POS. Anyway, we still owe on this place but KNOW that no one will pay a penny for this place. So, I’m wondering if my husband agreed to a voluntary repossession and we got the mortgage in my name how bad would that hurt us?

Best answer:

Answer by dirttrackgirl_77
althought the reposession is voluntary, he is still going to owe the money for the mobile home. It may show as a voluntary repo, but if he chooses NOT to pay the remaining balance, it will become a profit and loss writeoff or collection and it will eventually ruin his credit

Q&A: I would like to put a house for sale –via an auction. Does anyone know a serious auction house in Canada?

Question by s t: I would like to put a house for sale –via an auction. Does anyone know a serious auction house in Canada?
I am looking for a serious “auction house” in Quebec, Canada — the object is the sale of a heritage house in the Province of Quebec. Serious replies welcome.

eBay or eBay Canada

Seriously.

You don’t have to really “auction” your house off. You can just pay to list it on the eBay Real Estate section and let the millions of eBay users VIEW the house but not actually BID on it. It’s a great way to get TONS of people to see your house.
