If I owe back rent for an apartment and i pay it before the court date do i still get evicted?

Question by Esha K: If I owe back rent for an apartment and i pay it before the court date do i still get evicted?
My roommate didn’t pay his half of rent for three months and now we owe back rent and are getting evicted. On the summons it says that we owe $ 1,304 in back rent. If i pay all of that before the court date will the judge dismiss the eviction and will I get to stay in my apartment?

How long does a NYC landlord have to ask for back rent before eviction?

Question by Jess T: How long does a NYC landlord have to ask for back rent before eviction?
I have a friend of mine going through an dilly of a perdicament. She has been living in a rent stabilized unit for 10 years on the Upper West Side. Recently she received an eviction notice saying that she owed back rent from 1999.

They asked her to furnish proof of payment but could not (who keeps receipts that long?) So does anyone know anything about tenent law and if this is even legal? The total of monies they claim she owes is 00 – a pitance I know, but still – can they evel legally evict her for that?

She should consult with an attorney, or speak to the tenants’ rights folks at City Hall.

A debt that old may be uncollectible. Additionally, time is of the essense in eviction cases for non-payment of rent so something that old is not likely to be enforceable even if it is valid and collectible.

Most likely the landlord is trying to kick her out so that he can raise the rent. Such tactics are illegal in NYC though some sleazy landlords will still try.

Q&A: I am trying to buy a house through the quick sale process, before it forecloses…?

Question by sotomann: I am trying to buy a house through the quick sale process, before it forecloses…?
we already made an offer to the bank and it was accepted pending the owner signs a promissary note stating they would repay part of the monies due. It doesn’t look like the owners will sign, and it will go through the foreclosure process. What happens to my bid? Does it affect my bid when this forecloses, or is it just a technicallity? Bottom line, do I get the house?
This will be our house, not an investment.

Q&A: When can I expect to get my last month’s rent back if I vacate my apartment before my last month’s rent is due?

Question by Ana Wyssmann: When can I expect to get my last month’s rent back if I vacate my apartment before my last month’s rent is due?
I am on a month-to-month lease. My landlord is moving into my duplex in order to save money. I am all paid up for this month, but gave him my last month’s rent prior to occupancy. I also paid a seperate security deposit which he’s promised to get back to me within 30 days of vacating the property.

Ask your landlord. Since you are doing him the favor vacating early he should pay you immediately.

How can I get a $6000 loan to stop the repossession process before they find my car?

Question by andre_us3000: How can I get a 00 loan to stop the repossession process before they find my car?
I purchased a Ford Mustang in 2007, got financed from a bank that after 2 years and half, the bank sold all the car loans to a different bank. Without having any info about this bank, I missed a couple of payments being in between jobs, last month I got a job where I did save around 00 this month but the bank won`t let me make the regular payments anymore. I have to pay in full what I own them or have the repossession will take my car. I put over 000 in this car that I really love and I do not want to loose it. My credit is destroyed, I have 00 cash and I need another 00 to pay it off. My sister is willing to help me, she got an `ok` credit score, she applied at Wells Fargo for 00, got approved with a 35% interest. She was supposed to get the money 5 to 7 business days but it`s been already 14 days and nothing seems to happen. The Repo is looking for the car for 2 weeks already and I`m afraid they gonna find it before I get the money. Please help me with any kind of information in order to get a loan and keep the car

I’d give them the car before I paid 35% interest. I suggest you do the same.

How long after foreclosure before you receive a 1099?

My house was foreclosed on in October 2009 in Maryland. At the foreclosure sell at the court house there were no bids on the house. I received papers from the court ratifying foreclosure in December 2009. The lender listed the property with a real-estate agent in October and sold the house. The new owners closed on the property January 19, 2010. How long after the foreclosure before I receive a 1099?
