Question by in love love love…: Question re ex-husband’s vehicle repossession?
My divorce was final in Oct. 2007. My ex asked for, and received his motorcycle in the divorce settlement and was given 30 days to get my name off of the loan. We purchased the motorcycle together (my member # at a credit union, but both names and ss# were on the loan). I knew he had not transferred it out of my name, but was being told by him that he was taking care of the payments. In July of 2008, I received a knock at my door, and there were three men wanting to repossess the motorcycle. I explained that it had not been in my possession since we separated in July of 2006, and gave them my ex’s phone # to contact him. Meanwhile, I contacted the bank to find out what had been going on, and discovered that he was 5 months behind on payments. Needless to say, I was furious, and couldn’t pay, at that time, the total amount that it would take to avoid the repossession.
I am now being hassled constantly for the amount remaining on the loan (was approx $ 6000 with the last debt collector…the new one says it is $ 10,000). They say that I am responsible, not him, and will not even consider talking to him. I have sent “cease contact” letters now to two different collection agencies over the past 2 1/2 years, and things seem to settle down for a while, then rear their ugly head months later, when the debt is “reassigned.” It is affecting my credit big time, to the point where I cannot help my fiance with a home loan, or even get something as minor as a loan at the dentist office to have my son’s teeth fixed. I know my ex wanted to hurt me, but this has affected his children even more so than me. I cannot see how it is fair to pay even one penny of his debt. He was hurtful and physically and emotionally abusive, and did this purposely, I am almost positive, to hurt me even more.
I don’t feel that suing him will do any good as he doesn’t have a pot to pi$ $ in, is already about $ 17,000 in arrears with his child support, and has not filed taxes in the past 5 years. Are there any attorneys who can give me some advice? We are in Florida, if that matters…

You made a big error in not making sure that your name was removed from the title / loan papers…………Has the bike been reposessed or not ?? If so, it would have been sold at auction, and both of you would be liable for the balance. You need to find out the status of the bike, then speak to a lawyer in person.
